Afghanistan has quietly voted for a regulation that allows Shia men to reject their wives food and edibles if they refuse to act upon their husbands’ sexual demands.

The new final draft of the legislation also grants custody of kids fully to their fathers and grandfathers, and requires women to get agreement from their husbands to work.

In April, US President Barack Obama and British Prime Minister Gordon Brown joined an worldwide chorus of disapprovel over an earlier version of the regulation, which legalized rape within marriage. But aides to President Hamid Karzai had insisted the rule provided further safety for women.

Karzai appeared to back down but activists say the revised rule is repressive and contradicts Afghanistan’s formation and the international treaties it is signed up to. The regulation is thought to be backed by the hardline Shia cleric Ayatollah Mohseni, who may have power over the voting intentions of Shias who make up twenty per cent of the population.

Its sexual clauses aimed only to ensure men's sexual needs were met within marriage, because Islam prohibited them seeking satisfaction with other women.

Why should a man and woman get married if there is no need for a sexual relationship? Then they are like brother and sister, Ayatollah told in an interview in his recently built central Kabul mosque and university complex.

A man and wife can negotiate how often it is reasonable to sleep together, based on his sex drive, and a woman has a right to refuse if she has a good reason, said Ayatollah.
